Learning Hub @ Peter Mac is operated by the Office of Cancer Education, a division of Peter MacCallum Cancer Centre (ABN 42 100 504 883).

By using this website, purchasing courses or products offered by Learning Hub @ Peter Mac or utilizing the organisation’s goods and services, the user agrees to the following Terms and Conditions, as well as any further terms outlined in our Privacy Policy, Code of Conduct or other agreements outlined by us and supplied on this website.

If the user does not adhere to these Terms and Conditions, or any further terms as outlined above, Learning Hub @ Peter Mac reserves the right to cancel your account, membership or subscription at any time without refund.

Learning Hub @ Peter Mac reserves the right to change these terms, conditions or agreements at any time. All changes will take effect when published to the website

3. Copyright and trademark

All content and materials available on this website or supplied by the Learning Hub @ Peter Mac or its representatives are the property of Peter MacCallum Cancer Centre and are protected by copyright under Australian and International copyright laws unless otherwise specified.

The user may access, download and print materials available on this website or provided by the Learning Hub @ Peter Mac or its representatives for personal and non-commercial use only, provided all Peter Mac branding and copyright information is not removed. When purchasing a course, product, good or service, the user is purchasing access rights or an account subscription. Purchase does not transfer ownership of any course materials, content or intellectual property of the Peter MacCallum Cancer Centre.

Copying, transferring or otherwise using materials or content provided on the site or supplied by Learning Hub @ Peter Mac or its representatives for commercial purposes is strictly prohibited. It is strictly prohibited to modify adapt or disseminate content or materials provided by the Learning Hub @ Peter Mac or its representatives for either commercial or non-commercial use.

 

4. Privacy, accounts and security

All data and accounts are managed in line with our Privacy Policy and adhere to applicable Victorian and Australian legal requirements.

 

5. Login and users

By registering for a Learning Hub @ Peter Mac account, the user agrees to take all reasonable steps to avoid generating multiple or duplicate user accounts and declares that all provided information is accurate and true. The user should notify Learning Hub @ Peter Mac of any changes in details in a timely manner.

Users shall not create an account using the name or details of another person with the intent to impersonate that person.

Users shall not create an account on behalf of another person without the permission of that person.

Users shall not create an account which includes details or login information that the Learning Hub @ Peter Mac deems to be inappropriate or offensive.

The user shall not share passwords and account login information with any third party unless with given express permission from the Learning Hub @ Peter Mac (learninghubsupport@petermac.org).

The user shall notify Learning Hub @ Peter Mac of any suspected or known unauthorized account use. Any fraudulent or unlawful activity may result in account termination and/or reporting to the relevant law enforcement agencies if applicable.

 

6. Site compatibility and function

This website and any content within is generally compatible with Windows, MacOS and Linux operating systems and the recent versions of most major web browsers including Google Chrome, Mozilla Firefox and Safari. Some pages of this website may require pop-ups to be enabled. We strongly recommend against the use of Internet Explorer as its use may lead to viewing issues for some course content. While we will make every reasonably practicable effort to assist the user in troubleshooting relating to site and content access and use, Learning Hub @ Peter Mac makes no guarantee of the compatibility and proper function of content and services contained on this website across all user devices. We make every effort to ensure that the server which makes content available to you is free of viruses and other harmful components, however this cannot be guaranteed.

 

 

7. Account cancellation and suspension

Learning Hub @ Peter Mac reserves the right to suspend a user account or subscription for any act or behaviour which we deem to be in breach of our Terms and Conditions, Privacy Policy, Code of Conduct or other agreements outlined by us and supplied on this website. This is at our sole discretion, may take effect immediately and will not result in refund of any funds paid by the user.

If the user requests a course or product refund or cancellation which is accepted and processed by Learning Hub @ Peter Mac (refer to our Refund Policy), and has not been enrolled in any other course, product or service, the user’s account will be suspended within 7 days of the processing of this refund.

If a user has an active registration or account which they wish to be suspended, the user must request this in writing to LearningHubSupport@petermac.org. We will endeavor to process your suspension requests within 7 days of receipt of request.

Upon suspension of your account, your user data will be managed in accordance with our Privacy Policy.

 

8. Accuracy and currency of information

All content, materials and information available on this website or supplied by the Learning Hub @ Peter Mac or its representatives is of a general nature and is for educational purposes only. While we make all reasonable efforts to ensure accuracy and currency, it is not to be considered formal medical or professional advice and is not tailored to your professional, medical, clinical or health circumstances. We do not offer medical advice to individuals.

While Learning Hub @ Peter Mac endeavors to periodically review all posts in public or community forums on this website, we do not consistently moderate material and shall not be held directly responsible or accountable for the content or messages posted by users and third parties.

When registering, the user will be given the option to allow promotional or advertising materials to be sent to them by Learning Hub @ Peter Mac or its representatives. This does not include information relating to course enquiries, session bookings, payment processing or other administrative information and communications.

We endeavor to send promotional or advertising materials only to those who have given permission for us to do so during the registration process or at any other stage.

When promotional and advertising materials are sent to the user as part of a mailing list subscription, the user has the option to opt out or cancel their mailing list subscription at any time.

We will not advertise third party products on behalf of another entity, and do not provide user data to third parties for the purpose of advertising third party products. For more information, please refer to our Privacy Policy.

 

12. User disputes

All users are expected to participate in online or face-to-face courses in a way that meets our Code of Conduct. Learning Hub @ Peter Mac does not take responsibility for disputes arising between users.

 

13. Fees and purchases

Current course prices are listed on this website or specified as per a corporate or other arrangement between the user and Learning Hub @ Peter Mac. Listed fees are non-negotiable.

By purchasing a product offered by us, you are purchasing subscription or access rights to a product or service. Purchase does not transfer ownership of any course materials or content.

 

14. Withdrawals, refunds and transfers

All course withdrawals, refunds and transfers requested by the user or occurring due to cancellations or adjustments made by Learning Hub @ Peter Mac or its representative will be handled in accordance with our refund policy.

 

15. Changes to service and pricing

Learning Hub @ Peter Mac aims to offer fair and accessible prices for all courses. From time to time, pricing may be adjusted to reflect changes in market value, increased costs of delivery or other reasons. Pricing changes will come into effect as soon as changes are updated on this website.

Purchases made prior to pricing changes will not incur new charges or discounts arising from changes in product or service cost.  Any future purchases will incur charges reflecting the current listed price on this website.

Any alternative pricing or discount arrangements made for corporate clients, bulk purchases or other purposes are subject to review and adjustment by Learning Hub @ Peter Mac at any time or as specified in the terms of a quote or written offer.

 

16. Separate agreements and corporate arrangements

Any agreements or arrangements made between Learning Hub @ Peter Mac and a corporate client, bulk purchaser or other user are in addition to these Terms and Conditions and any other agreement, and are subject to review and adjustment by Learning Hub @ Peter Mac at any time or as specified in the terms of a quote or written offer.

 

17. Privacy

All data collected by Learning Hub @ Peter Mac is handled in accordance with our Privacy Policy and applicable privacy laws.

 

 

18. Limitation of liability

Learning Hub @ Peter Mac, the Office of Cancer Education, Peter MacCallum Cancer Institute and its representatives shall not be held liable for any direct or indirect damages arising out of or connected to the authorized or unauthorized access and use of our content, goods and services or that arise due to mistakes, omissions, delayed or failed delivery, interruption, deletion, defect, communication line failure, computer virus, theft or destruction or unauthorized access to information or property, or use of records or programs or files.

 

19. Indemnity

You agree to defend, indemnify and hold Learning Hub @ Peter Mac, Office of Cancer Education and Peter MacCallum Cancer Institute and its staff, agents an representatives harmless from and against any claims, actions, demands, liabilities or settlements including, without limitation, reasonable legal and accounting fees, resulting from or alleged to result from your violation of these Terms and Conditions.

 

 

20. Reservation of rights

Learning Hub @ Peter Mac reserves all its rights, including but not limited to any and all copyrights, trademarks, patents, trade secrets, and any other proprietary right that may be available on our website or the goods and services provided. The use of these rights and property requires prior written consent. Learning Hub @ Peter Mac is not providing you with any implied or express licenses or rights by making services available to you and you will have no rights to make any commercial uses of the website or service without prior written consent.

 

21. Governing law

By using Learning Hub @ Peter Mac website, goods and services, you agree that applicable Australian federal law and Victorian state law will govern these Terms and Conditions and any dispute that may arise between you and Learning Hub @ Peter Mac.
